1. Welcome and Scope of This Privacy Policy . This Privacy Policy (the “Policy”) explains the online privacy practices and policy of LIC Development Owner, L.P. (the “LIC” ) for our web site at www.jacksonparklic.com (the “Site”), providing information about Jackson Park, an exciting new residential building located in Long Island City. Specifically, this Policy explains the information we collect when you visit the Site or social media pages on Facebook and Instagram and operated by or on behalf of LIC relating to Jackson Park and how we use and share this information. It does not apply to any other web site owned or operated by LIC or its affiliates.
Please note that if you click on the “Apply” button at the top of the home page of the Site, you will be taken to RentCafe.com, a third party vendor we use to assist with processing your application. While you are completing the application on RentCafe.com or otherwise browsing that website, you are no longer on the server hosting the Site. You should review the terms of use and privacy policy for RentCafe.com to see how they collect and use information you provide them while you are on their website. You can access those documents at

Additionally, RentCafe.com, per our instruction, provides your completed application to OnSite.com, another vendor retained by LIC, to verify the information in your application such as checking with the references you have provided and confirming your employment history. OnSite.com is contractually prohibited from using this information in any manner except in connection with your application. However, your information may be stored temporarily or for the relevant legal period by OnSite.com.
After OnSite.com completes its review of your application it will provide us with a report. If your application is denied based on any information provided to us by OnSite.com, you are entitled to review this report. OnSite.com will contact you with information on how you may receive that information if a negative report is issued. This Policy does not apply to any mobile application offered by RentCafe.com or OnSite.com.
If you become a tenant at Jackson Park, you will have access to a tenant portal providing you access to building information and other related services. This Policy does not apply to that tenant portal.
We also remind you that this Privacy Policy is part of and incorporated into the Terms of Use (the “Terms”) for the Site which you may access at https://jacksonparklic.com/legal/.
By using this Site you are agreeing to the Terms including this Policy. If you do not agree to these Terms and Policy you should exit the Site immediately.
2. Our Right To Modify This Policy. We reserve the right to revise this Policy at any time in our sole discretion at any time with or without advance notice. If we make any substantive changes, we will post bulletins on the Site and update the date noted above. We reserve the right to provide notice of any changes in other ways as well. Your use of this Site after such changes constitutes your agreement to the Policy as amended.
3. This Site Is Governed By U.S. Law. This Site is operated, in whole or in part, from the United States. By using this Site, regardless of where you live in the world, you consent to have any personally identifiable information (“PII”) you provide through this Site transferred to and processed in the United States, and allow LIC to use, collect, and share your personal information in accordance with this Policy. You also agree that we may use your non-PII as set forth in this Policy.
Text on this Site may be published in languages other than English. In all instances, the English language version of any text, including this Privacy Policy, controls the legal impact and interpretation of this Site and its use.
4. What Information We Collect
A. Personally Identifiable Information, Non-Personally Identifiable Information and Aggregated Information
a. Personally Identifiable Information (“PII”) refers to information that identifies you such as your name, address, social security number, state driver’s license number, email address, your bank account, or other financial information. PII also includes any non-PII such as your computer’s IP address if we link that information to your PII.
b. Non-PII refers to other information we may collect about you anonymously or in the aggregate. For instance, we track how users navigate the Site, which website they were on immediately before visiting the Site and which website they navigate to when they leave the Site. Non-PII may also include information about search terms or internet advertising that led you to the Site. If we link this information to your actual profile then we treat this information as PII.
c. We also collect information about visitors to the Site in aggregate form and in this aggregated form, this information is treated as Non-PII.
B. How We Collect PII
We do not collect PII about you when you visit the Site unless you voluntarily provide it to us. In order to apply for an apartment at Jackson Park you will need to complete an application at RentCafe.com. The information you provide in the application will be shared with us by RentCafe.com and will be treated as PII except when used in aggregated form. We may also receive additional PII about you from OnSite.com after it completes its review of your application. .
If you contact us by e-mail (through a hyperlink on a webpage, or otherwise), then we naturally will have your e-mail address and name and any other information in your message. If in the future you receive our promotional e-mails, you can opt out of receiving these messages at any time by following the opt-out instructions in the e-mail that you receive.
C. How We Collect Non-PII
a. When you visit the Site we also collect non-PII about you such as how you navigate the Site, which browser you use, your computer IP address, and if you accessed the Site from your mobile device the name of your carrier and some characteristics about your mobile device. We also may track how many times you visited the Site and the time and date of those visits. However, in collecting this information we do not link it to your PII and do not know your identify.
b. In connection with these activities, we may use standard technologies such as a “cookie” to collect information. A cookie is a small removable data file that is stored by your web browser on your computer. We use cookies to, among other things, identify your computer during a particular visit to this Site and analyze visitor behavior. We do not store personal or sensitive information in cookies. Most web browsers provide you with the ability to accept or decline cookies, as well as to be warned each time a cookie is being sent.
c. Google Analytics and Web Beacons. Our Site uses Google Analytics, a web analysis service provided by Google, in order to better understand your use of our Site and how we can improve it. Google Analytics collects information such as how often users visit a website, what pages you visit when you do so, and what other websites you used prior to coming to such website. Google Analytics collects only the IP address assigned to you on the date you visit a website, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with your PII. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit a website, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to our Website is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Google utilizes the data collected to track and examine the use of the Website, to prepare reports on its activities and share them with other Google services. Google may use the data collected on the Website to contextualize and personalize the ads of its own advertising network. d. Web Beacons. Some of the areas of the Site may contain electronic images known as web beacons (sometimes known as clear gifs) that allow us, and our third party providers or affiliates, to count and track users who have visited certain portions of the Website. Web beacons collect only limited information and do not collect any of your personal information. Specifically, we plan to use a type of web beacon known as a “retargeting pixel,” which will allow users to receive targeted advertising from us via certain social media websites, including Facebook.com.
e. Facebook and Instagram. If you visit the Jackson Park pages on Facebook or Instagram or “Like” us on Facebook, we receive certain information about you as permitted under the Facebook and Instagram terms of use and privacy policy. 5. How We Share and Use PII
a. LIC is affiliated with Tishman Speyer Properties (“Tishman Speyer”), a property owner/manager which is involved with Rockefeller Center, The Chrysler Building, the MetLife Building, and other properties within New York and also around the globe. LIC may share PII we collect from this Site with Tishman Speyer or companies affiliated with Tishman Speyer who may use this information to send you information relating to other properties owned or managed by Tishman Speyer or events sponsored by or taking place on properties owned or managed by Tishman Speyer. You may opt out of receiving additional emails from Tishman Speyer by following the instructions at the bottom of any such email.
b. Neither LIC, Tishman Speyer, or any affiliate of Tishman Speyer will share your PII with any non-affiliated company, except for vendors and service providers that assist us or these related companies with marketing and/or web related activities. These vendors and service providers are obligated to not use your PII in any manner except as necessary to assist with the activities described above.
c. There are limited circumstances, however, when we may share your PII with third parties. We may release PII and any other data in order to comply with the law, in order to investigate, prevent, or take action regarding suspected or actual prohibited activities, including but not limited to fraud, and situations involving potential threats to the physical safety of any person. We may also do so to enforce the Site’s Terms of Use and this Policy, to protect LIC, its affiliates, or for any similar reason, in LIC’s sole discretion.
d. We also reserve the right to transfer PII to either an affiliate or an unrelated third party as part of a transfer of LIC’s business or business assets including the Site. Any entity or person acquiring your PII as part of any corporate transaction will be contractually obligated to honor the commitments made in this Policy until you have been given notification of any changes.
6. How We Use and Share Non-PII
a. We use non-PII to help us improve the Site and to make it easier for users to navigate and find the information they are seeking. We may also use this information to help us with marketing Jackson Park and attract more visitors to the Site.
b. We may also share this Non-PII in aggregated form with Tishman Speyer and its affiliates for their use in designing similar sites or to improve their own marketing and advertising.
c. We may also share this Non-PII with third parties to perform services on our behalf and to help us improve the Site and its content.
d. At the present time we do not share any information with any online advertising networks.
7. Security.
a. LIC takes reasonable precautions to safeguard the confidentiality of any information you submit to us via this Site as well as to keep this Site free from viruses or other malware. We endeavor to provide a secure website, but cannot guarantee the confidentiality of electronic communications. Transmissions to and from the Site are not encrypted, nor are e-mail messages. (In contrast, when you complete the tenant application you provide this information via the RentCafe.com website which utilizes security protocols consistent with the PII you are submitting to us via the RentCafe.com website.) Accordingly, you should carefully consider whether to submit sensitive information that you would not want made public, and should recognize that your use of the Site is solely at your own risk including the risk that your PII could be compromised by someone hacking into our server or otherwise accessing your PII without consent. As stated in the Terms, we disclaim any responsibility or obligation to compensate any person who suffers injury as a result of such breach even if that breach is due to our negligence.
b. If you elect to complete an online application on RentCafe.com you also accept the risk that despite the security precautions taken on that web site that your information could be hacked or stolen If you do not wish to take these risks contact the Jackson Park rental office to discuss alternative ways you may submit your rental application.

8. Promotions; E-mail; Social Media Marketing.
a. From time to time, we may request information from you via online polls, surveys, sweepstakes, or contests. Participation in these surveys, sweepstakes, or contests is completely voluntary; you have a choice whether or not to disclose information required to enter. Information requested may include personal contact information such as your name, address, phone number, mobile phone number, e-mail address, username, and/or similar information.
b. If you sign up to receive our e-mail newsletter, e-mail updates, or text messages from us, we may collect, store, and use your e-mail address and mobile phone number to send you such information. We may also collect and store other PII including but not limited to your name, address, phone number, number, username, and/or similar information you may voluntarily provide to us.
c. LIC maintains a presence on third party social media websites. When you share any content on our social media pages you irrevocably consent to our reposting your content on our other social media pages or on the Site. Of course, any content you post on social media may be copied and reposted by other users without your permission. If you have any questions concerning the use of your content on social media you should review the policies of the relevant social media platform.

This Site may contain links to other web sites. LIC is not responsible for their privacy practices or content.
YOUR CALIFORNIA PRIVACY RIGHTS
9. Notice To California Residents: Your California Privacy Rights. If you are a California resident, you have the right to receive from us once a year, free of charge: a) information identifying any third party company(ies) to whom LIC may have disclosed, within the past year, PII pertaining to you and your family for that company’s direct marketing purposes; and b) a description of the categories of PII disclosed. If you are a California resident and would like to make this request, please email your request to [email protected].
California law requires that we indicate whether we honor “Do Not Track” settings in your browser. This setting is intended to allow customers who do not to wish to receive targeted advertising from third party based on their Internet browsing activity. Like many other websites and online services, LIC does not currently alter its practices when it receives Do Not Track signals because there is no consensus among industry participants as to what “Do Not Track” means in this context. At this time we do not work with nor share any PII with companies that engage in targeted advertising.
